By downloading, installing, or using the Pools mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Mark Chafin ("we," "us," or "our") regarding your use of the App.

2. Description of Service

Pools is an NFL pick'em pool management application that allows users to:

• Create and manage NFL weekly picks pools
• Join existing pools created by other users
• Make weekly game predictions
• Track standings and leaderboards
• Compete with friends and other pool members

The App is intended for entertainment purposes only and does not facilitate real-money gambling or betting.

3. User Accounts

3.1 Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account

3.2 Account Eligibility

You must be at least 13 years old to create an account and use the App. By using the App, you represent that you meet this age requirement.

4. Subscriptions and Payments

4.1 In-App Purchases

The App may offer in-app purchases, including the ability to create pools. All purchases are processed through Apple's App Store or other applicable platform payment systems.

4.2 Pricing

Prices for in-app purchases are displayed in the App and may vary by region. All prices are subject to change without notice.

4.3 Refunds

Refund requests are handled according to Apple's App Store refund policies. Please contact Apple directly for refund inquiries.

5. User Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to any part of the App
• Use automated systems or bots to interact with the App
• Collect or harvest user information without consent
• Use the App for real-money gambling or betting

6. Intellectual Property

6.1 Our Rights

The App, including its design, features, and content, is owned by Mark Chafin and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

6.2 NFL Trademarks

NFL team names, logos, and related marks are trademarks of the National Football League and its member teams. The App is not affiliated with, endorsed by, or sponsored by the NFL or any of its teams.

6.3 User Content

You retain ownership of any content you submit to the App (such as pool names). By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content within the App.

7. Disclaimers

7.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7.2 Game Information

While we strive for accuracy, we do not guarantee the accuracy of NFL game schedules, scores, or other game-related information displayed in the App.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE PAST TWELVE MONTHS.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App will immediately cease.

You may delete your account at any time by contacting us at the email address below.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Texas.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
